Welcome to the Cibo Espresso My Cibo Loyalty Program.

1.1 This document describes the Terms and Conditions that form the basis of the My Cibo Loyalty Program.  These Terms and Conditions are effective from the date of signing up to the My Cibo Loyalty Program.  The My Cibo Loyalty Program is only valid within eligible Cibo Espresso stores within Australia.
1.2 You must read this document carefully before using the My Cibo Loyalty Program.  By using the Card you are agreeing to the Terms and Conditions.  If you do not understand these Terms and Conditions or if you have any questions please contact: mycibo@ciboespresso.com.au.
1.3 Cibo Espresso reserves the right to vary, amend or make any changes to these Terms and Conditions from time to time without prior notice in its absolute discretion.  Any changes to these terms and conditions will be communicated on our website and become effective at the time of posting on our website.  Registering for the Program and/or using the Card to earn any rewards will constitute your acceptance of these Terms and Conditions.  While Cibo Espresso will attempt to notify Members of any change, we shall not be liable in any way for failure to do so.
1.4 If you retain and use your Card after any changes are posted on our Website, your use of your Card will be subject to those changes.
1.5 Cibo Espresso will not accept any liability for any email communication to any Member that is misdirected, lost or not received.
1.6 Cibo Espresso will not accept any liability for any technical issues that may cause damage to any computer related to or used in connection with the My Cibo Loyalty Program.
1.7 Cibo Espresso may collect personal information from Members for the purpose of facilitating the My Cibo Loyalty Program.  Please see Cibo Espresso’s Privacy Policy which can be found on our website: http://www.ciboespresso.com.au/  for more information.

2.1 The Terms and Conditions and membership to the My Cibo Loyalty Program are governed by and will be construed in accordance with the laws of the State of South Australia irrespective of where the application for membership has been completed by the Member or submitted to Cibo Espresso. Any action or other legal process with respect to any matter or thing in connection with these Terms and Conditions or membership in My Cibo Loyalty Program must, unless otherwise agreed to by Cibo Espresso, be instituted and carried on only in the appropriate Court or tribunal of the State of South Australia.

In these Terms and Conditions unless the context otherwise requires:
3.1 ‘Activation/Activate refers to the process required to activate the My Cibo Loyalty Card.
3.2 ‘Card’ means the My Cibo Loyalty Card.
3.3 ’Cibo Espresso’ or ‘We/Our/Us’ means Cibo Espresso Australia Pty Ltd.
3.4 ‘Caffe Menu Product’ means any product from the Caffe Menu (including infused tea, gelato shakes and gelato smoothies) available for purchase within an eligible Cibo Espresso Store.
3.5 “Eligible Cibo Espresso Stores” means all Cibo Espresso stores in Australia except the Adelaide Airport Cibo Espresso Store.
3.6 ‘Member/You’ means any individual visiting this website, using a Card or that has provided information to Cibo Espresso.
3.7 ‘Membership Year’ commences on the date you complete Activation and concludes after 12 months of no activity.
3.8 ‘Points’ means the points you accrue by purchasing Caffe Menu Products from Eligible Cibo Espresso Stores.
3.9 ‘Terms and Conditions’ mean the Terms and Conditions set out in this agreement and as updated on the Cibo Espresso website from time to time.

4.1 Activation of the My Cibo Loyalty Card is deemed acceptance of these Terms and Conditions and our privacy policy as set forth within this website and amended from time to time.
4.2 Please remember that the Card is and will always remain the property of Cibo Espresso and must be returned on demand.
4.3 The My Cibo Loyalty Program is open to any individual, of any age, but is limited to one Card per customer.
4.4 We offer membership to the My Cibo Loyalty Program at our discretion, giving us the right to accept or reject any application for membership at our sole discretion.
4.5 After receiving a Card from an Eligible Cibo Espresso Store you must activate your Card via the Cibo Espresso website. This can be done either:
4.5.1 Online through our website. Click on ‘My Cibo’ to complete the registration form; or
4.5.2 In Store using our in store iPad to visit the Cibo Espresso website
4.6 To activate your Card you are required to provide your allocated Membership Number (found underneath the barcode) and Verification Code (found in the bottom left hand corner of the card), your first name, last name, birth date, gender, postcode, email address, phone number, username and password.  This will help protect the earned Points allocated to your My Cibo account from unauthorised access in the event of loss, theft or damage to your Card.
4.7 If you do not agree with these Terms and Conditions please return your Card to an Eligible Cibo Espresso Store.
4.8 It is your responsibility to remember your username (email address) and password.
4.9 Remember, it is a condition of use that all information must be entered accurately and truthfully. If any of the information is incorrect, the services provided to you by Cibo Espresso may be affected.

5.1 If your Card has not been registered any accrued Points are lost as we have no way of identifying you.
5.2 If your Card has been registered but is now lost or stolen, you should IMMEDIATELY;
5.2.1 Suspend your Card directly at our Website.  You can reactivate your suspended Card at our Website if your lost Card is found.
5.3 You can obtain a replacement Card at a participating store. The replacement Card number must be added to your current registration to gain access to any Points balance in your My Cibo account.
5.4 We reserve the right to charge a replacement Card fee.
5.5 If you believe there has been unauthorised use of your card, please let us know as it is your responsibility to advise us.  Cibo Espresso will not be liable for misuse of a lost or stolen Card or any unauthorised use of a Card.
5.6 We may determine, at our sole discretion not to allow a replacement Card where we reasonably believe that the Card has been lost or stolen due to your wilful breach of the Terms and Conditions of if there are reasonable grounds for suspecting that you have been engaged in fraudulent or other unlawful conduct, in which case your existing Points balance will be forfeited and we shall have no further liability to you.
5.7 If you think there may be a discrepancy, you must inform Cibo Espresso within one month of the transaction. We cannot make amendments after this timeframe. You will need to provide us with proof of the transaction, so remember to keep your receipts.  Cibo Espresso will be the final arbiter in any dispute about your Points balance.
MyCibo Members are entitled to a free Birthday coffee on the day of their birthday or 1 day either side of their actual birth date upon presentation of their MyCibo Card, confirming their date of birth registered on the card matches the date of visit to the store. This free Birthday coffee cannot be redeemed on any other day regardless of external circumstances including but not limited to public holidays, store closures etc. This free Birthday coffee is non-transferable and cannot be exchanged for cash. CIBO Espresso does not take responsibility for incorrectly entered birth dates during the registration process. Free coffee is one regular caffe size only and does not include any extras including: soy / zymil / extra shot / decaf or size options.  Not available with any other offer. Not available at CIBO Espresso Adelaide Airport.

6.1 Points can be earned as soon as your Card is swiped in store.  Rewards can only be redeemed if the Card is registered.  Please note that you can continue to collect points on an unregistered Card.
6.2 Once your Card is activated, you must produce your Card prior to making each purchase so that a Cibo Espresso staff member can scan it and you can accrue Points.
6.3 You can keep track of your Points balance at http://www.ciboespresso.com.au/ or by asking a Cibo Espresso employee at an Eligible Cibo Espresso Store.
6.4 Your Points are not transferable to another individual’s Card. They are for your use only.
6.5 Once you have activated your card, points will be earned through Eligible Transactions by presenting your card at the time of purchase as follows:
6.5.1 Ten (10) Points for every dollar you spend at an Eligible Cibo Espresso Store on Caffe Menu Products (i.e. if you purchase a Caffe Menu Product for $3.00 incl GST, you would receive 30 Points).
6.6 You may not be able to earn Points during special promotions or competitions or when we give you free or promotional products (this includes taste testing and product samples).
6.7 If you have not used your Card to accrue Points within a 12 month period from the date of your last purchase, your account will be deactivated and your points account balance will be reset to zero.
6.8 You can reactivate your Card online. Remember, Points can only be accrued on an activated Card.
6.9 Once your Points have expired, Cibo Espresso cannot re-credit them and is not liable in any way for expired Points.

7.1 You will require enough Points to be eligible for redemption. Keep track of your Points balance online, or ask a Cibo Espresso staff member to swipe your card before each purchase.
7.2 You may only redeem points against purchases made in participating Cibo Espresso outlets.  Each point equals one cent when redeemed against a purchase.  You must have sufficient points to pay in full for a purchase if you wish to redeem points.  You may not make part payment for a purchase using redeemed points.
7.3 Once you have accrued a minimum of 290 points you are entitled to purchase a Caffe Menu Product to the value of $2.90.  For example, 350 points = item valued at $3.50.
7.4 Points can only be redeemed for Caffe Menu Products, electronically at the point of purchase in an Eligible Cibo Espresso Store and cannot be processed without an activated Card.
7.5 You need to inform a Cibo Espresso staff member that you wish to redeem your points before you order your product and you must provide proof of your identity if requested by a Cibo Espresso staff member at this time.
7.6 Points redeemed for Caffe Menu Products are not eligible for refund or re-credit after purchase.
7.7 Cibo Espresso will not be held responsible or liable if points are not able to be redeemed for whatever reason but specifically, in the case of a technical failure of software or hardware.

8.1 Once your Card is registered, you can view your Card activities at our Website at any time.  If you need to change any of the details or preferences you have registered with your My Cibo Card, you can also do this directly via our Website.
8.2 You may access your account information to:
8.2.1 View your Points balance,
8.2.2 Review your Points transaction history,
8.2.3 Update your personal information,
8.2.4 Change your password,
8.2.5 Suspend/delete your Card (in the event of suspected loss, theft or fraudulent use of your Card).
8.3 You should obtain, examine and retain all receipts and other transaction records issued to you at the participating store and compare against your activity reports available at our Website.  You agree to check your account activities frequently and notify us of any erroneous, improper, or unauthorised transactions within seven (7) days of such occurrence.

9.1 Cibo Espresso reserves the right at all times to make any changes to the My Cibo Loyalty Program Terms and Conditions in its sole discretion.
9.2 You will be taken to have received notice of any changes to these Terms and Conditions if Cibo Espresso posts the amended Terms and Conditions on the Cibo Espresso website http://www.ciboespresso.com.au/
9.3 Cibo Espresso is not liable for any Caffe Menu Product not being available.
9.4 Cibo Espresso expressly reserves the right in its absolute discretion to withdraw, cancel, withhold, deny access to or use of or in any way change any of your Points balance or the available Caffe Menu Products.  Cibo Espresso will not be liable for any loss or damage suffered by you resulting from such withdrawal, cancellation, denial, variation or change.
9.5 Cibo Espresso gives no warranty as to the continuing availability of the My Cibo Loyalty Program.
9.6 Cibo Espresso expressly reserves the right to terminate or alter (whether materially or otherwise) the My Cibo Loyalty Program at any time.
9.7 Cibo Espresso reserves the right at any time in its absolute discretion and without notice to suspend or terminate your membership and/or your right to use your Card.
9.8 You can withdraw from the My Cibo Loyalty Program at any stage. Please send Cibo Espresso your request via email (mycibo@ciboespresso.com.au).For Cibo Espresso to cancel your account, return your Card to an Eligible Cibo Espresso Store. Once your Card has been received, all information contained in your membership account will be deleted from our database in accordance with our privacy policy
9.9 Any breach of these Terms and Conditions by you whether intentional or otherwise may result in suspension or termination of your membership and/or cancellation of Points at the sole discretion of Cibo Espresso.
9.10 In the event of suspension or termination of your membership your Points balance will be returned to zero.
9.11 Cibo Espresso reserves the right to cancel or refuse to honour any attempt by you to redeem Points which were obtained in breach of the Terms and Conditions at any time, without liability.
9.12 Cibo Espresso reserves the right to reverse or cancel any Points credited to you incorrectly or not in accordance with or in breach of the Terms and Conditions at any time without liability.
9.13 Cibo Espresso reserves the right to suspend your membership, reverse or cancel any Points from your account in the event that monies are owed by you to Cibo Espresso or any of its subsidiaries and such monies remain unpaid after the due date.
